Confused whether you are a Resident or an NRI?<\/p>\n<p id=\"ember1223\" class=\"ember-view reader-text-block__paragraph\">Check your residency status under both the Income Tax Act &amp; FEMA in under 30 seconds here: <a class=\"qnYTlArzYtboRwdjbntMpxxVLYbykXIogw \" tabindex=\"0\" href=\"https:\/\/tally.so\/r\/J91j47\" target=\"_self\" data-test-app-aware-link=\"\">https:\/\/tally.so\/r\/J91j47<\/a><\/p>\n<p id=\"ember1224\" class=\"ember-view reader-text-block__paragraph\">Most people assume residency is a simple label. It isn\u2019t. You could be a Resident under the Income Tax Act and Non-Resident under FEMA at the same time. And that\u2019s where most mistakes (and tax issues) begin.<\/p>\n<hr class=\"reader-divider-block__horizontal-rule\" \/>\n<h2 id=\"ember1225\" class=\"ember-view reader-text-block__heading-2\">\ud83d\udccc Residency under the Income Tax Act (Purely based on physical presence. Passport or citizenship does NOT matter.)<\/h2>\n<h3 id=\"ember1227\" class=\"ember-view reader-text-block__heading-3\">Step 1: Resident or Non-Resident?<\/h3>\n<p id=\"ember1228\" class=\"ember-view reader-text-block__paragraph\">You are treated as a Resident in a financial year if any one of the following is satisfied:<\/p>\n<p id=\"ember1229\" class=\"ember-view reader-text-block__paragraph\">1\ufe0f\u20e3 You were in India for <strong>182 days<\/strong> or more during the relevant year, <strong>OR<\/strong><\/p>\n<p id=\"ember1230\" class=\"ember-view reader-text-block__paragraph\">2\ufe0f\u20e3 You were in India for <strong>365 days or more<\/strong> in the last <strong>4 years and 60 days or more<\/strong> in the relevant year.<\/p>\n<p id=\"ember1231\" class=\"ember-view reader-text-block__paragraph\">\u26a0\ufe0f Important exception (often missed):<\/p>\n<p id=\"ember1232\" class=\"ember-view reader-text-block__paragraph\">For Indian citizens \/ PIOs visiting India whose Indian income (excluding foreign income) exceeds \u20b915 lakh, the 60-day condition becomes 120 days.<\/p>\n<p id=\"ember1233\" class=\"ember-view reader-text-block__paragraph\">If neither condition is met, you are a <strong>Non-Resident (NR)<\/strong> for tax purposes.<\/p>\n<hr class=\"reader-divider-block__horizontal-rule\" \/>\n<h3 id=\"ember1234\" class=\"ember-view reader-text-block__paragraph\">Step 2: If Resident, are you ROR or RNOR?<\/h3>\n<p id=\"ember1235\" class=\"ember-view reader-text-block__paragraph\">Once classified as Resident, the law checks two additional conditions:<\/p>\n<p id=\"ember1236\" class=\"ember-view reader-text-block__paragraph\">1\ufe0f\u20e3Resident in at least 2 out of the last 10 years, <strong>AND<\/strong><\/p>\n<p id=\"ember1237\" class=\"ember-view reader-text-block__paragraph\">2\ufe0f\u20e3Stayed in India for 730 days or more during the last 7 years.<\/p>\n<ul>\n<li>If both are met \u2192 Resident &amp; Ordinarily Resident (ROR)<\/li>\n<li>If either fails \u2192 Resident but Not Ordinarily Resident (RNOR)<\/li>\n<\/ul>\n<p id=\"ember1239\" class=\"ember-view reader-text-block__paragraph\">\ud83e\udde9 You become RNOR by default if:<\/p>\n<ul>\n<li>You are an Indian citizen \/ PIO with Indian income &gt; \u20b915 lakh and stayed 120\u2013181 days, or<\/li>\n<li>You are a Deemed Resident (Indian citizen, income &gt; \u20b915 lakh, not liable to tax in any other country)<\/li>\n<\/ul>\n<hr class=\"reader-divider-block__horizontal-rule\" \/>\n<h2 id=\"ember1241\" class=\"ember-view reader-text-block__heading-2\">\ud83d\udccc Residency under FEMA (Purely based on intentions.)<\/h2>\n<p id=\"ember1242\" class=\"ember-view reader-text-block__paragraph\">FEMA doesn\u2019t care only about days. It cares about purpose and intention.<\/p>\n<p id=\"ember1243\" class=\"ember-view reader-text-block__paragraph\">Under FEMA, a person is considered Resident in India if they stayed in India for more than 182 days in the preceding financial year.<\/p>\n<p id=\"ember1244\" class=\"ember-view reader-text-block__paragraph\">\u2757 But even after 182 days, you are treated as Non-Resident under FEMA if:<\/p>\n<ul>\n<li>You went abroad for employment, business, education or vocation, or<\/li>\n<li>You went abroad with an intention to stay outside India for an uncertain period<\/li>\n<\/ul>\n<p id=\"ember1246\" class=\"ember-view reader-text-block__paragraph\"><strong>This is why<\/strong>: You can be Resident under Income Tax but Non-Resident under FEMA, or vice versa.<\/p>\n<hr class=\"reader-divider-block__horizontal-rule\" \/>\n<p id=\"ember1247\" class=\"ember-view reader-text-block__paragraph\">Consequences of getting this wrong can mean:<\/p>\n<ul>\n<li>Excess tax<\/li>\n<li>Invalid investments<\/li>\n<li>FEMA violations<\/li>\n<\/ul>\n<p id=\"ember1249\" class=\"ember-view reader-text-block__paragraph\">Want clarity in under 30 seconds?
